Participation in the Program constitutes your acceptance of Terms and the Dollarwise Terms of Use Agreement, including, but not limited to, the Dispute Resolution and Class Action Waiver provided therein, and you acknowledge that you have read our Privacy Policy (incorporated herein by reference). In the event of a discrepancy between the Privacy Policy or Terms of Use and these Terms with respect to the Program, these Terms will control.

Eligibility: To participate in the Program, you must have an active Dollarwise account in good standing. Program is void where prohibited and subject to all applicable federal, state and local laws. 

How to Participate: You can access your personal referral page at https://app.dollarwise.com/profile/referrals ("Referral Page"), which contains a unique referral link ("Unique Link") that you may share with your personal contacts to recommend Dollarwise for the opportunity to earn rewards for Successful Referrals (as defined below). You should only invite your personal contacts who you know want to receive a referral. You are not permitted to use the Program for spamming. Limit one (1) account per person. 

Self-referrals, referrals to accounts you own or control, duplicate or fake accounts, bots, and any automated or fraudulent referral activity are void and may result in disqualification of all associated referrals and forfeiture of rewards at our sole discretion. 

Please note that because you can earn rewards for successful referrals, whenever you promote your Unique Link publicly, you must clearly and conspicuously disclose that you have an incentive or financial relationship with Dollarwise (for example, by using #Ad or a plain statement that you earn rewards for referrals), consistent with the FTC’s requirements and guidelines, including, for example, the FTC’s Guides Concerning the Use of Endorsements and Testimonials at https://www.ecfr.gov/current/title-16/chapter-I/subchapter-B/part-255. Participants who are influencers or brand partners are also subject to separate written terms. Without limiting any of the foregoing, you further represent and warrant that your participation in the Program, including, for example, your related referral activity, will comply with all applicable laws, rules, and regulations. 

In addition, you should only include true and accurate information about Dollarwise and Dollarwise products and services in your communications about the Program.

Successful Referral: A new user who is not an existing or prior Dollarwise account holder, who signs up through your Unique Link and converts from a trial to a paid Dollarwise subscription that the user does not cancel, and that is not refunded or reversed, within thirty (30) days of conversion date will be deemed a “Successful Referral.” Note that Dollarwise applies an additional fifteen (15) day internal reconciliation period following the first thirty (30) days (“Reconciliation Period”). 

Rewards: You can earn $5 for each Successful Referral who signs up for a monthly subscription and $15 for each Successful Referral who signs up for an annual subscription (each, a “Reward”), subject to an annual cap of $1,500 in referral earnings per calendar year (January 1 to December 31) (“Reward Cap”); if you reach the Reward Cap, you will not accrue Rewards for Successful Referrals in that calendar year. These amounts are paid in the form of virtual prepaid cards, as discussed below.

Your Dollarwise account must be active and in good standing at the time the Reward is provided. If you have cancelled your Dollarwise account or your account is not in good standing prior to issuance of a Reward, any pending Rewards will be forfeited. 

Rewards are paid out monthly based on the number of Successful Referrals earned during the previous month after the conclusion of the Reconciliation Period. Rewards are distributed as virtual prepaid cards delivered through Blackhawk Network (“BHN”) and issued by Sunrise Banks N.A. Each card is subject to its Cardholder Agreement and to the following required disclosures: This virtual card is issued by Sunrise Banks N.A., Member FDIC, pursuant to license by Mastercard International Incorporated. Mastercard and the circles design are registered trademarks of Mastercard International Incorporated. No cash access or recurring payments. The card can be used everywhere Debit Mastercard is accepted, for phone orders, or in stores that accept mobile wallet. The card is valid for up to twelve (12) months; unused funds will forfeit after the valid-thru date. Use of the card constitutes acceptance of the terms and conditions stated in the Cardholder Agreement.

If you reach more than 100 Successful Referrals, you may be excluded from further participation in the Program; however, you may be considered for participation in a future affiliate program if Dollarwise decides to launch one. 

Rewards are provided “as is” with no warranty or guarantee, either express or implied. You may not substitute, assign or transfer a Reward or redeem a Reward for cash, but we reserve the right, at our sole discretion, to substitute a reward with one of comparable or greater value. You are responsible for federal, state and local taxes associated with Reward acceptance and use. All Reward details are at Dollarwise’s sole discretion.

General Conditions: Released Parties (as defined below) are not responsible for the actions of participants in connection with the Program. We reserve the right to exclude any individual from the Program, disqualify them from participating in future referral programs or other promotions, or cause the forfeiture of any Reward if they violate these requirements.  Any attempt to use multiple names, email accounts, or other unfair, unsportsmanlike, or unlawful tactics to gain Successful Referrals may result in disqualification from the Program. ANY ATTEMPT TO DAMAGE OR UNDERMINE THE LEGITIMATE OPERATION OF THE PROGRAM MAY VIOLATE CRIMINAL AND CIVIL LAW, AND THE RELEASED PARTIES RESERVE THE RIGHT TO SEEK DAMAGES AND OTHER REMEDIES (INCLUDING ATTORNEYS’ FEES) FROM ANY SUCH PERSON TO THE FULLEST EXTENT PERMITTED BY LAW.

We reserve the right to modify or discontinue the Program (or any part thereof) either temporarily or permanently, with or without notice at any time and in any way, including, but not limited to, changing or limiting rewards, revising these Terms, the Dollarwise Terms of Use, or the website or app. Any changes to these Terms will be effective immediately upon the posting of the revised Terms, and we will indicate at the top of this page the date these terms were last revised. Your continued participation in the Program constitutes your agreement to any revised version of these Terms. We will not be liable to you in the event of any modification, suspension or discontinuance of the Program. We reserve the right to terminate participation in the Program at any time and for any reason or to cancel, revoke, or otherwise prevent the issuance of Rewards in any suspected case of fraudulent use or misuse of the Program. 

Release of Liability: To the fullest extent permitted by applicable law, and as a condition of participation, you agree to release, discharge, indemnify, and hold harmless Dollarwise, its parent, subsidiaries, affiliates, advertising, fulfillment, and marketing agencies, reward suppliers or fulfillment vendors, including BHN, and any other vendors or service providers involved in the Program and all of their respective officers, directors, agents, employees and representatives (collectively, “Released Parties”) for: (1) any liability, claims, costs, losses, and damages of any kind relating to or arising in whole or in part, directly or indirectly, from participation in the Program; (2) any indirect, special, incidental, exemplary, consequential, treble or punitive losses; or (3) damages arising from interruptions, system error, failure or malfunction, or delays in operation or transmission. The limitations set forth in this section shall apply regardless of the form of action, whether the asserted liability or damages are based on contract, indemnification, tort, strict liability, statute or any other legal or equitable theory. Nothing in these Terms excludes or limits liability that cannot be excluded or limited under applicable law, including liability for death or personal injury caused by negligence or for fraud.

Participants’ indemnity obligations apply to all liabilities or expenses arising from claims, losses, damages, judgments, fines, litigation costs, and legal fees. Participants will cooperate fully as reasonably required by Dollarwise in our defense of any such claim. Released Parties reserve the right, at their own expense, to assume the exclusive defense and control of any matter subject to indemnification by participants.

You acknowledge that the Released Parties’ sole and entire maximum liability to you for any reason, and your sole and exclusive remedy for any claim or demand, will in no circumstances exceed the actual out-of-pocket costs incurred by you, not to exceed $100. If applicable law does not allow all or any part of the above limitation of liability to apply to you, the limitations will apply to you only to the extent permitted by applicable law.

To the fullest extent permitted by applicable law, the Released Parties assume no responsibility or liability for: (a) lost, late, incomplete, delayed, misdirected, or garbled Unique Links, referral data, account activity, Rewards, emails, or other communications of any kind; (b) incorrect or inaccurate information or faulty or failed data transmissions; (c) unauthorized access to, or theft, destruction, or alteration of, referral or account data; (d) any technical malfunction, failure, error, interruption, or delay of any network, hardware, software, or service used in any aspect of the Program; (e) inaccessibility or unavailability of the internet or the Dollarwise app; (f) any injury or damage to any person or property related to or resulting from participation in the Program; or (g) other errors or difficulties of any kind whether human, mechanical, electronic, computer, network, typographical, printing or otherwise relating to or in connection with the Program, including, without limitation, errors or difficulties which may occur in connection with the administration of the Program, the processing or tabulating of Successful Referrals, the functionality of Unique Links, the announcement of the Rewards, or in any Program-related materials. 

Data Collection and Privacy: Personal information collected in connection with the Program will be used as described in our Privacy Policy. Information may be shared with BHN and service providers for purposes of administering the Program and providing Rewards.

This Program is in no way sponsored, endorsed, administered by, or associated with any social platform or any other third-party platform used to promote it, and each participant releases those platforms from all liability arising from or related to the Program.
